ADP Statement on Mark Brnovich’s Statement on ARS 13-3603 and  Abortion Access in Arizona

 

PHOENIX — Today, just days after the Supreme Court overturned Roe v. Wade and effectively ended abortion access in the state of Arizona, Attorney General turned GOP Senate primary candidate Mark Brnovich claimed an extremely restrictive 1901 abortion ban as the law of the land.

 

The 121-year-old law criminalizing abortion was created before Arizona even became a state and requires mandatory jail time for doctors who provide abortion health services in the state of Arizona. The territorial-era law contains no exceptions for cases of rape or incest.

 

As a reminder, 87% of Arizona voters — including 89% of Independents and 81% of Republicans — support the right to safe and legal abortion. 

 

Of note: Today is just Brnovich’s latest and most dangerous attempt to politicize his official office for personal gain to boost his Senate bid.

 

Following Mark Brnovich’s announcement, Arizona Democratic Party Chair Raquel Terán released the following statement:

 

“Attorney General Brnovich’s attempt to take Arizona back in time over a century and implement an extreme law that goes against what the overwhelming majority of Arizonans want is a blatant, pathetic abuse of power. This judgment from Mark Brnovich is exactly what extremist Republicans have been counting on since the Roe reversal — legal chaos and confusion —  while lives hang in the balance. 

 

“To my fellow Arizonans who are continually horrified by the actions of dangerous, out-of-touch Republicans in the war against our bodies: Arizonans are a united front on this issue, and we stand ready to protect mothers, families, doctors, and medical professionals because no one should be thrown in jail for providing or receiving essential medical care.”
